Make a Bureaucrat Run – Just Ask Them for the Facts

As usual, I spent my week helping people resolve problems. And as usual, that means I’m going to spend a lot of time talking to the psychopaths that are attacking them. This week was no different.
The first is a call from Monday 25 Feb 2013 to the IRS. We had been on hold for over 9000 hours, so it was nice to finally speak to an agent about the form letters my client had received. The letters had opinions generated from a computer that my client was obligated to file returns. We didn’t see any evidence of jurisdiction.
The call was pretty short, though I did cut the initial few minutes where my client was verifying who she was so the agent would speak to me. I mentioned we didn’t see any facts proving the constitution and code are applicable and there is jurisdiction over my client. The agent just got angry and said she was ending the call. I asked if she was aware of any facts the code was applicable and the IRS had jurisdiction over my client and she hung up on us.
Seems asking for the facts is like kryptonite to superman:
You must file a return you filthy peasant!
And your facts proving this?
I’m hanging up!
Just to address any criticism the poor IRS agent was not a lawyer and not qualified to answer such questions regarding evidence, the following call is with a professional litigator with an advanced university degree, a prosecutor. This is a very instructional call; so if you’re being prosecuted for a code violation, you’ll know you’re not dealing with someone skilled in logic and constructing lucid arguments.
This prosecutor called me yesterday, 1 March 2013 regarding a speeding ticket James called the No State Project about last week. This one ends fast also, though not at the breakneck speed of the IRS call. When you listen to the call, you’ll notice all I want to know are the facts the code applies to James. This professional litigator cannot answer.
She does the best she can and essentially admits there are no facts, it’s just how it works. Then she says: “You’re in my state, my law applies.” No facts, just platitudes and her say so. The law applies because she says so.
Do I really need to point out “You’re in my state, my law applies” is not evidence of anything, except maybe arrogance? But this is all government apologists can offer, no evidence, just opinions.
This is also a very instructive call because it demonstrates how easily you can defeat the political nonsense the constitution/laws and statutes apply because of your physical location. This doesn’t matter if you’re in California, Canada, England or wherever the attack originates from.
Then we see a common tactic to avoid the embarrassment of not being able to prove your precious laws apply, the “are you a lawyer” ploy. I mention that my membership in a labor union is not relevant to whether she has evidence. Predictably, she hung up on me; just like Kevin Shannon had done a few hours earlier.
Kevin accused me of violating Ohio law because I was allegedly practicing law without a license. I emailed him for the evidence the Ohio code applies to me. This is the main part of the email to Kevin:
“During our brief phone call today, you accused me of violating Ohio law, that I was practicing law without a license. I’m curious, what facts if any, do you rely on proving Ohio law applies to me at all? Do you have any personal, first hand knowledge of any facts Ohio law applies to me?”
I’m not expecting a response from this officer and counselor of the court who is supposed to be administering justice. But maybe Kevin will surprise me.
If anyone is a skeptic (always encouraged) or just thinks I’m clueless and don’t know what I’m talking about, then please feel free to call the show and offer the phantom evidence the codes apply that has eluded every prosecutor, judge, and IRS agent I’ve ever spoken with. Call in and do what Kevin was unable to do.
