International Definition (United Nations)<\/span><\/span><\/span>The official international definition of human trafficking comes from the United Nations Protocol to Prevent, Suppress and Punish Trafficking in Persons, Especially Women and Children (also known as the Palermo Protocol), adopted in 2000. According to the UN Office on Drugs and Crime (UNODC), human trafficking is defined as:<\/span><\/span><\/span>“The recruitment, transportation, transfer, harbouring or receipt of persons, by means of the threat or use of force or other forms of coercion, of abduction, of fraud, of deception, of the abuse of power or of a position of vulnerability or of the giving or receiving of payments or benefits to achieve the consent of a person having control over another person, for the purpose of exploitation. Exploitation shall include, at a minimum, the exploitation of the prostitution of others or other forms of sexual exploitation, forced labour or services, slavery or practices similar to slavery, servitude or the removal of organs.” <\/span><\/span><\/span><\/p>\n

This definition emphasizes three key elements: the act (recruitment, transportation, etc.), the means (force, fraud, coercion, etc.), and the purpose (exploitation). Notably, the consent of the victim is irrelevant if any of the means are used, and for children under 18, no means need to be proven if exploitation is involved.<\/span><\/span><\/span>United States Definition<\/span><\/span><\/span>In the US, the primary official definition is provided by the Trafficking Victims Protection Act (TVPA) of 2000, as amended. The US Department of Justice defines human trafficking as a crime involving the exploitation of a person for labor, services, or commercial sex. <\/span><\/span><\/span><\/p>\n

  • Sex Trafficking<\/span><\/span>: The recruitment, harboring, transportation, provision, obtaining, patronizing, or soliciting of a person for the purpose of a commercial sex act, in which the commercial sex act is induced by force, fraud, or coercion, or in which the person induced to perform such act has not attained 18 years of age. <\/span><\/span>\n

  • Labor Trafficking<\/span><\/span>: The recruitment, harboring, transportation, provision, or obtaining of a person for labor or services, through the use of force, fraud, or coercion for the purpose of subjection to involuntary servitude, peonage, debt bondage, or slavery. <\/span><\/span>\n

    Under US law, force, fraud, or coercion are not required for minors in sex trafficking cases\u2014any commercial sex act involving a minor is considered trafficking. <\/span><\/span><\/span><\/p>\n

    This aligns closely with the UN definition but is tailored to US federal enforcement, with penalties under 18 U.S.C. \u00a7 1589-1594.<\/span><\/span><\/span>These definitions are used by agencies like the Department of Homeland Security, Department of Labor, and Department of State for identification, prosecution, and victim support. <\/span><\/span><\/span><\/p>\n
