Make a Bureaucrat Run \u2013 Just Ask Them for the Facts<\/strong><\/p>\nPosted on March 2nd, 2013 by Marc Stevens<\/p>\n
As usual, I spent my week helping people resolve problems.\u00a0 And as usual, that means I\u2019m going to spend a lot of time talking to the psychopaths that are attacking them.\u00a0 This week was no different.<\/p>\n
The first is a call from Monday 25 Feb 2013 to the IRS.\u00a0 We had been on hold for over 9000 hours, so it was nice to finally speak to an agent about the form letters my client had received.\u00a0 The letters had opinions generated from a computer that my client was obligated to file returns.\u00a0 We didn\u2019t see any evidence of jurisdiction.<\/p>\n
The call was pretty short, though I did cut the initial few minutes where my client was verifying who she was so the agent would speak to me.\u00a0 I mentioned we didn\u2019t see any facts proving the constitution and code are applicable and there is jurisdiction over my client.\u00a0 The agent just got angry and said she was ending the call.\u00a0 I asked if she was aware of any facts the code was applicable and the IRS had jurisdiction over my client and she hung up on us.<\/p>\n
Seems asking for the facts is like kryptonite to superman:<\/p>\n
You must file a return you filthy peasant!<\/p>\n
And your facts proving this?<\/p>\n
I\u2019m hanging up!<\/p>\n
Just to address any criticism the poor IRS agent was not a lawyer and not qualified to answer such questions regarding evidence, the following call is with a professional litigator with an advanced university degree, a prosecutor.\u00a0 This is a very instructional call; so if you\u2019re being prosecuted for a code violation, you\u2019ll know you\u2019re not dealing with someone skilled in logic and constructing lucid arguments.<\/p>\n
This prosecutor called me yesterday, 1 March 2013 regarding a speeding ticket James called the\u00a0No State Project\u00a0about last week.\u00a0 This one ends fast also, though not at the breakneck speed of the IRS call.\u00a0 When you listen to the call, you\u2019ll notice all I want to know are the facts the code applies to James.\u00a0 This professional litigator cannot answer.<\/p>\n
She does the best she can and essentially admits there are no facts, it\u2019s just how it works.\u00a0 Then she says: \u201cYou\u2019re in my state, my law applies.\u201d\u00a0 No facts, just platitudes and her say so.\u00a0 The law applies because she says so.<\/p>\n
Do I really need to point out \u201cYou\u2019re in my state, my law applies\u201d is not evidence of anything, except maybe arrogance?\u00a0 But this is all government apologists can offer, no evidence, just opinions.<\/p>\n
This is also a very instructive call because it demonstrates how easily you can defeat the political nonsense the constitution\/laws and statutes apply because of your physical location.\u00a0 This doesn\u2019t matter if you\u2019re in California, Canada, England or wherever the attack originates from.<\/p>\n
Then we see a common tactic to avoid the embarrassment of not being able to prove your precious laws apply, the \u201care you a lawyer\u201d ploy.\u00a0 I mention that my membership in a labor union is not relevant to whether she has evidence.\u00a0 Predictably, she hung up on me; just like\u00a0Kevin Shannon\u00a0had done a few hours earlier.<\/p>\n
Kevin accused me of violating Ohio law because I was allegedly practicing law without a license.\u00a0 I emailed him for the evidence the Ohio code applies to me.\u00a0 This is the main part of the email to Kevin:<\/p>\n
\u201cDuring our brief phone call today, you accused me of violating Ohio law, that I was practicing law without a license.\u00a0 I\u2019m curious, what facts if any, do you rely on proving Ohio law applies to me at all?\u00a0 Do you have any personal, first hand knowledge of any facts Ohio law applies to me?\u201d<\/p>\n
I\u2019m not expecting a response from this officer and counselor of the court who is supposed to be administering justice.\u00a0 But maybe Kevin will surprise me.<\/p>\n
If anyone is a skeptic (always encouraged) or just thinks I\u2019m clueless and don\u2019t know what I\u2019m talking about, then please feel free to call the show and offer the phantom evidence the codes apply that has eluded every prosecutor, judge, and IRS agent I\u2019ve ever spoken with.\u00a0 Call in and do what Kevin was unable to do.<\/p>\n
